TERMS & CONDITIONS

These Terms and Conditions govern the legal relationship between participants and the organiser of the Fjällräven New Zealand Trail (hereinafter “the Event”). The Event is managed by Fjällräven ANZ Pty Ltd (hereinafter “the Organiser”) and professionally guided by BCWanaka Ltd, currently trading as; Basecamp Adventures, Climbing Queenstown, Wanaka Rock (hereinafter “the Guides”). By completing registration, the participant acknowledges and agrees to the following terms.

Section 1: Participation

By registering for the Event and purchasing a ticket, the participant confirms their intent to participate and consents to the use of their personal data for purposes related to the administration and operation of the Event.

The Organiser reserves the right to deny or remove a participant from the Event at any time if:

  • False or misleading personal information has been provided,
  • There is reasonable suspicion the participant is unfit to safely participate,
  • There is suspicion of criminal or inappropriate behaviour.

Section 2: Participation Requirements

Participants are responsible for ensuring they meet any local or national health and safety requirements (e.g., COVID-19 vaccination, health declarations) prior to participating in the Event. While the Organiser will aim to communicate such requirements, compliance is the responsibility of the participant.

It is the responsibility of participants to check for any travel restrictions or entry requirements into New Zealand before purchasing a ticket and before travel. The Organiser assumes no liability or obligation for refunds due to such restrictions.

Participation is entirely at the participant’s own risk. Participants must assess and confirm their physical and mental fitness to complete a multi-day trekking event in natural unpredictable conditions.

Participants must be 18 years or older on the day the Event begins, unless accompanied by or with written consent from a legal guardian. Guardians must be contactable during registration.

All participants must be prepared for the challenges of long-distance trekking, including physical and psychological endurance.

Participants are required to sign and agree to the waiver from the Organiser. Participants must always follow the instructions provided by the Organiser and event guides. Failure to comply may result in expulsion from the Event at the Participants cost.

Participants must familiarise themselves with and follow New Zealand’s fire, waste, and environmental protection regulations, and any directions from the Guides. Any breach may be reported to local authorities and may result in removal from the Event at the Participants cost.

Section 3: Liability

The Organiser may alter the Event schedule, postpone or cancel the Event if conditions are deemed unsafe or due to force majeure, including extreme weather, natural disaster, pandemic, or political unrest. In such cases, a refund of the participation fee may be offered, but will take up to 30 days for processing post event. No further claims (financial or otherwise) will be accepted.

The Organiser is not liable for damages caused by gross negligence unless it involves a breach of fundamental duties, or results in personal injury (death, physical harm, or health issues). This limitation also applies to agents or partners acting on behalf of the Organiser. This limitation does not affect any rights participants may have under the Consumer Guarantees Act 1993 or other applicable laws.

The Organiser accepts no liability for health risks associated with participation. Each participant is solely responsible for confirming their own physical ability to complete the Event and must not have been advised against participation by a medical professional.

Participants are personally responsible for any health consequences arising from the consumption of alcohol, drugs, or medication during the Event.

Should medical assistance be required, participants consent in advance to treatment. Any medical services or transport (e.g., helicopter evacuation) must be covered by the participant. The Organiser does not provide insurance or cover these costs. Participants acknowledge and accept responsibility for these risks during registration.

All participants are solely responsible for their personal belongings and equipment. The Organiser does not accept liability for lost, damaged, or stolen items, including those stored or handled by third parties.

Participants must ensure they have adequate health insurance that covers emergency medical care and evacuation in remote or natural areas of New Zealand.

Section 4: Participation Fee

Participation fees using discount codes are not valid; we reserve the right to cancel any such sales at our discretion.

Participation fees are non-refundable, except where required under New Zealand consumer law. If a participant can no longer attend the Event, they are encouraged to resell their ticket, and update all details through our contact page. Any resale must include updating participant information through our customer service team, and the replacement participant must be aware of the Terms and Conditions of Participation and Liability Waiver.

Please note refunds for ticket fees but will take up to 30 days for processing post event.

Section 5: Photography and Filming

By registering, participants agree that they may be photographed or filmed during the Event. The Organiser retains the right to store, process, and publish photos, videos, and interviews featuring participants (“Material”) for promotional purposes across printed materials, digital platforms, and social media, including via Fjällräven and affiliated brands.

If a participant objects to close-up or individual filming, they must inform photographers or staff on site. However, group or wide-angle footage where individuals may appear incidentally will not be excluded.

The Organiser may display participant names and imagery in Event results, media coverage, and other promotional contexts.

Section 6: Additional Limitations of Liability

The Organiser is not responsible for:

  • Errors or delays in digital systems or transmission,
  • Service disruptions, data loss, or technical issues,
  • Viruses or malicious code,
  • Unauthorised access to personal data.

Exceptions to this limitation include damages caused intentionally or by gross negligence, or those involving injury to life or health. This clause does not limit any rights participants may have under New Zealand law, including the Consumer Guarantees Act or Fair Trading Act.
